This policy explains what personal information The Fujita Collection collects through this website, how it is used and shared, and the choices and rights you have. It applies only to this website.

1. Who is responsible for your information
This website is operated by Daryl and Reid Fujita (“we”, “us”, “our”), private sellers based in Hawai‘i, State of Hawai‘i, United States of America. We are the party responsible for the personal information described here (the “data controller” under laws that use that term).

2. The short version
- We only collect personal information you choose to send us — primarily through the inquiry form.
- We use it to respond to your inquiry and discuss a possible private sale. We do not sell your information.
- This website uses no advertising or analytics cookies and no third-party tracking. See our Cookie Policy.
3. Information we collect
Information you give us
When you use the inquiry form (or email or call us), we collect the details you provide. Through the form these are: your name, email address, and — if you choose to add them — your phone number, shipping destination, the artwork title and reference code you are interested in, your message, and whether you would like additional photographs or a condition report.
Information collected automatically
Like virtually all websites, our hosting provider keeps standard server logs when pages are requested (for example IP address, browser type, and the time of the request). These logs are used for security and to keep the site running; we do not use them to build profiles of visitors.
We do not run web analytics, advertising pixels, social media trackers, or any third-party scripts on this site.
4. How and why we use your information
We use the information you submit to:
- respond to your inquiry and answer your questions;
- discuss availability, pricing, condition, documentation, shipping and the steps of a possible private sale;
- keep records of our correspondence with you; and
- comply with our legal obligations.
Where data-protection laws such as the EU/UK GDPR apply, our legal bases are: your consent (which you give by submitting the form), our legitimate interest in responding to and managing inquiries, and taking steps at your request before entering into a contract. Where we rely on consent, you may withdraw it at any time.
5. Cookies and tracking
This website does not set advertising or analytics cookies and does not track you across sites. Our Cookie Policy explains this in full.
6. Who we share your information with
We do not sell or rent your personal information, and we do not share it for advertising. We use a small number of service providers who process information on our behalf so we can operate the site and reply to you:
- Formspree — Processes contact-form submissions and forwards them to us. (privacy policy)
- Google (Gmail) — Receives and stores inquiry emails sent to us. (privacy policy)
- Our hosting provider — Serves the website and keeps standard server logs (e.g. IP address, browser type).
We may also disclose information if required by law, to enforce our terms, or to protect our rights, safety, or property.
7. International data transfers
We are based in the United States, and some of our service providers (for example our form provider and email provider) also process data in the United States. If you contact us from the United Kingdom, the European Economic Area, or another region with data-transfer rules, your information may be transferred to and processed in the United States. Where such transfers require a safeguard, they are intended to rely on recognised mechanisms such as the EU–U.S. / UK Data Privacy Framework or Standard Contractual Clauses. (To be confirmed by counsel and by each provider’s current certification.)
8. How long we keep your information
We keep inquiry correspondence for up to 24 months after our last contact, unless a longer period is needed to complete a transaction, resolve a dispute, or meet a legal obligation — after which we delete or anonymise it. You can ask us to delete it sooner (see your rights below).
9. Your rights and choices
Depending on where you live, you may have the right to: access the information we hold about you; correct it; delete it; restrict or object to certain processing; receive a portable copy; and withdraw consent. Residents of California and similar jurisdictions have rights to know, delete, and correct, and to opt out of the “sale” or “sharing” of personal information — we do not sell or share your personal information in that sense.
To make a request, email Daryl Fujita at Daryl.pfc@gmail.com. We aim to respond within 30 days. We will not discriminate against you for exercising these rights. If you are in the UK or EEA and believe we have not handled your data properly, you may also complain to your local data protection supervisory authority.
10. Children’s privacy
This website is intended for adults and is not directed to children. We do not knowingly collect personal information from children under 16 (or under 13 in the United States). If you believe a child has provided us information, please contact us and we will delete it.
11. How we protect your information
We use reasonable technical and organisational measures to protect the information we hold, including serving this site over an encrypted (HTTPS) connection. No method of transmission or storage is completely secure, however, so we cannot guarantee absolute security.
12. Changes to this policy
We may update this policy from time to time. When we do, we will revise the effective date shown above and, where appropriate, provide a more prominent notice.
